The terms for buying photos, and how Birdmark Studios handles personal data under the Data Protection (Jersey) Law 2018.

Photos purchased from Birdmark Studios are licensed to you for personal, non-commercial use — printing, keeping, and sharing with friends and family or on your own social media. Copyright in the photographs stays with Birdmark Studios. Please don't resell them, use them commercially, or pass the download on for others to use without our written permission.

Purchased photos are delivered as digital downloads via a link we email to you. Your link stays valid for a limited period (shown around the time of purchase), so please save your photos somewhere safe. Because the files are delivered instantly and can't be returned, sales are generally final once your download link has been issued — but if a download fails or you were charged in error, contact us and we'll put it right.

Photos shown in galleries are lower-resolution, watermarked previews. The version you download after purchase is full-size and free of watermarks.

Birdmark Studios is a Jersey-based event photography business and is the “controller” of the personal data described here for the purposes of the Data Protection (Jersey) Law 2018. We keep what we collect to a minimum. In short:

  1. Your email address, provided at checkout. We use it to send your download link and receipt, and to help with any order queries. Legal basis: performance of our contract with you.
  2. Payment details. Card payments are handled by our payment provider, SumUp. We never see or store your full card number — we only receive confirmation that a payment succeeded, and a reference. Legal basis: performance of our contract with you.
  3. Event photographs. We photograph people at public events. Where you're identifiable in an image, that image is your personal data. Legal basis: our legitimate interests in running an event photography service and offering these photos for sale — balanced against your rights, which include the right to object and to ask us to remove your photo (see below).
  4. Search tagging. To help people find themselves, we may use automated tools to detect things like race/bib numbers, vehicle registrations, and general keywords in images. This is used only to make galleries searchable — it isn't used to make any decision about you.
  5. Basket data. Your selected photos are stored in your own browser so your basket survives a refresh. This stays on your device and isn't an account.

We don't sell your personal data. We use a small number of trusted providers to run the service — a payment processor (SumUp), and hosting, storage and infrastructure providers that store the galleries and run the site. Some of these providers may process data outside Jersey; where they do, we rely on the cross-border transfer safeguards required by Part 8 of the Data Protection (Jersey) Law 2018.

Download links expire after the limited period shown at purchase. We keep order and receipt records for as long as we need them to run the business and meet our legal and accounting obligations. Event galleries are kept while they're relevant and removed or archived after that. We don't keep personal data longer than we need it.

Under the Data Protection (Jersey) Law 2018 you have the right to ask us to: give you access to the personal data we hold about you; correct it if it's wrong; erase it; restrict how we use it; object to our using it (including objecting to a photo of you being shown or sold); and, where it applies, receive it in a portable format. To exercise any of these, email hello@birdmarkstudios.je and we'll respond within the timeframe the Law allows.

If you appear in a gallery and would like your photo removed, just tell us which event and describe the shot — we'll take it down promptly, no questions asked.

Request removal

If you're unhappy with how we've handled your personal data, we'd like the chance to put it right — please contact us first. You also have the right to complain to Jersey's regulator, the Jersey Office of the Information Commissioner (JOIC), at jerseyoic.org.
